Hanefi mezhebinde te'vîl prensibi

Abstract

Çalışma giriş, üç bölüm ve sonuçtan oluşmaktadır. Girişte kısaca araştırmanın amacı, önemi,kaynakları ve yöntemi belirtilmiştir.Birinci bölümde İslam Hukuku'nda te'vîlin nasıl tanımlandığı, diğer kavramlarla olan ilişkisi, Hz. Peygamber'den başlanarak devirlere (sahabe dönemi, tabiin dönemi ve modern dönem) ve çeşitli disiplin ve ekollere göre nasıl anlaşılıp tatbik edildiği incelenmiştir.İkinci bölümde te'vîlin alanı, konusu, hükmü, bağlayıcılığı, türleri ve şartları üzerinde durulmuştur.Üçüncü bölümde ise hanefî mezhebine göre te'vîlin yöntemlerinden ve ilkelerinden bahsedilmiştir.This study consists of an input, three chapters and results.In the input it is indicated the aim, the sources and the method of the study.In the first chapter has been examined the meaning of tawil/interpretation, the relationship between the other consepts and also how the various disciplines and schools understand the word tawil.In the second chapter has been addressed the subject of tawil, its provision, its conditions, and also its types.In the third chapter gives some information about the methods and principles of tawil according to hanafi school
