| dc.description.abstract | Genel hukuk literatürü içerisinde özgün bir yapıya sahip olan islâm hukuk metodolojisi (usl-i fıkıh), islâm hukukunun (fıkhın) önemli konularından biri olan emir ve nehiy konusunu ayrıntılarıyla incelemektedir. Zira emir ve nehiy konusu, fıkhın kısımları olan ibadet, muamelat ve ukubat (ceza hukuku) konuları ile yakından ilgilidir.Bu nedenle, islam hukuku geleneğinde önemli bir yere sahip olan mam Serahsû, otuz ciltlik meşhur el-Mebst'unu imlâ ettirdikten sonra, bu eserde ele aldığı fer'û meselelereait konulara temel teşkil etmesi için telif ettirdiği el-Usl adlı eserinde, emir ve nehiykonusunu farklı görüşlere de yer vererek ele almıştır. Dolayısıyla, islâm Hukuk Metodolojisinde mam Serahsû'ye Göre Emir ve Nehiy adlı tezimizde sözü edilen konunun, bu kaynak eserde ne şekilde ele alınıp, hangi esaslar çerçevesinde temellendirildiği incelenmiştir. | tr_TR |
| dc.description.abstract | Methodology of Islamic law (us al-fiqh) has an original structure in general lawliterature and it elaborates command and forbid which is one of important topics ofIslamic law (fiqh). For, the command and forbid is closely related to branches ofIslamic law, i. e. worship, mu`mal and uqbt (penal law). Imam al-Sarakhsexamined the command and forbid referring to different point of views in his al-Uslwhich he wrote to be a basis for accessory problems in his distinguished work, al-Mabst.
