| dc.description.abstract | Kavâid ilmi müstakil bir ilim dalı olarak ancak fıkıh ilminin tedvininden sonra, yani hicri IV. asırda ortaya çıkmıştır. Müslümanlar arasında böyle bir ilmin doğmasındaki en önemli etkenlerden biri, fıkıh ilminin oluşum sürecinden itibaren, İslam hukukçularının zihninde ana ilkelere dayanan hukuk anlayışının ve ortaya konan zengin bir malzemenin var olmasıdır. Kavaid ilminin en önemli özelliklerinden biri, fıkhın genel maksatlarını ve temel hedeflerini anlamayı sağlayarak, dağınık meselelerle meşgul olan fakihin, dağınık bir zihin yapısından kurtulmasını, belirli bir yöntem dâhilinde düşünmesini ve böylece fıkhın esaslarına muttali olmasını temin etmesidir. İslam hukukunun orijinalliği ve ayırıcı vasfı bu kaideler ile bilinir ve bunlar sayesinde ortaya çıkar. Külli kaideler olmadığı zaman İslam hukukunun, karmaşık meseleler ve cüz'i hükümler şeklinde kalacağı ve dış görünüş itibariyle çelişkili hükümler koleksiyonu şeklinde görüleceği açıktır. | tr_TR |
| dc.description.abstract | Kavaid/rules science as a separate branch of science have been developped only after the codification of Islamic Jurisprudence in hijri fourth century. The very reason for the emergence of such a branch among Muslims, from the beginning of the evolution of Islamic Jurisprudence, is the existence of notion of codification based on general rules in the minds of Muslim jurists and abundance of written material in this field.One of the most important feature of the kavaid is to enable understanding of the basic goals and aims of the fiqh/Islamic jurisprudence and doing this to empower the jurist to concentrate and to think in a methodical way just to be able to understand basic principals of the fiqh/Islamic jurisprudence. Through these principals it is possible to understand the originality and distinguished character of the fiqh/Islamic Jurisprudence. It is clear that without general principals/külli kaideler Islamic Jurisprudence would be seen as a collection of complicated subjects and some simple judgments. | en_US |
