Abstract
İnsanoğlu yüzyıllar boyunca pek çok kaynağın kullanımında olduğu gibi suyun kullanımında da ekonomik davranmamış, suyun tükenebilecek bir meta olduğunun bilincine varamamıştır. Son yıllarda nüfus artışı, su kaynaklarının plansız kullanılması, küresel ısınma ve bunun yol açtığı iklim değişiklikleri gibi unsurlar kuraklık sorununu beraberinde getirmiş bu da bir su bilinci politikasının oluşturulması zorunluluğunu doğurmuştur. Son yıllarda ekonomik ve sosyal gelişmesini belirli bir düzeye getirmek için sınıraşan sularından faydalanma yönünde yoğun bir çaba içine giren Türkiye bir çok projeyi uygulama alanına koymuştur. Bu projeler, komşu devletler ile bir takım uyuşmazlıkların doğmasına neden olmuş, bunların bir kısmı anlaşmalarla çözüme kavuşturulurken, önemli bir kısmına çözüm getirilememiştir. Su sorununun uluslar arası bir mahiyet alması, ülkeleri bu sorunun çözümü için ortak kavram ve hukuk anlayışı arama çabalarına itmiştir. Özellikle sınıraşan sularla ilgili olarak ortaya çıkan sorunların çözümüne katkı sağlayacak ve tüm ülkeler tarafından da kabul görecek bir hukuk sisteminin oluşturulması için değişik platformlarda çalışmalar başlatılmıştır Bu tezin hazırlanmasındaki amaç, Türkiye'nin sınıraşan suları hakkında bilgi vermek, sınıraşan suların hukuksal boyutunu incelemek, sınır aşan suların Türkiye'ye çevresel yönden etkilerini tespit etmek ve Avrupa Birliği uyumu ile ilgili önemli bir şart olan Su Çerçeve Direktifi ile bu etkilerin arasındaki ilişkiyi belirlemektir. Bu çalışma ile ilk önce Türkiye'nin sınıraşan suları incelenmiş ve bu suların çevresel problemleri araştırılmıştır. Bu problemlerin çözümünde Su Çerçeve Direktifi'nin rolü ortaya konulmaya çalışılmıştır. Ayrıca, bu çevresel problemlerin giderimin de olumlu etki sağlayan etkenler de incelenmiştir.
For centuries, just like many different natural resources, human being have acted very carelessly about using water. But mankind couldn't realise that water is not an endless resource. In recent years, growing population, unplanned use of water resources, global warming and climate changes accordingly have brought the drought problem and it forced us to create a new water consciousness policy. Turkey, who gets into an intensive struggle in the direction of taking advantage of her transboundary waters in order to bring her social and economic developments to a specific level, in recent years, puts lots of projects into practice. These projects cause some disagreements to arise with the neighbouring states, an important part of these disagreements hasn't been solved yet,while some of them have reached solutions with treaties. Water problem's getting an international quality leads the countries to struggle for search of a common concept and understanding of law in order to solve this problem. Studies have been started in different fields of the world so that a law system, which is to contribute to the solution of the problems emerged especially related to transboundary waters and to be admitted by all the countries could be formed. The purpose in preparation of this study is to give information about the Turkey's transboundary waters, to examine these waters' legitimate aspects, to ascertain the effects of them to Turkey, to identify the relation between these effects and the water frame directive – which is a significant requirement in EU integration process. With this study, firstly, Turkey's transboundary waters were examined and the environmental problems of these waters have been investigated. The role of water Frame directive in solving these problems was tried to be worked out / betrayed. Furthermore, influences for good in solving these environmental problems were investigated, too.
