| dc.description.abstract | Hanefî mezhebinde mezhep içerisinde birçok meselede ihtilaf edilmiştir. Bu ihtilaflı meselelerde hüküm veya fetva verebilmek, muhâlif görüşlerden birini diğerlerine tercih etmeye bağlıdır. Ayrıca hukûkî emniyet ve istikrar açısından da mezhepteki râcih görüşlerin tespit edilmesi bir ihtiyaçtır. Bu nedenle tarih boyunca Hanefî fakihlerin en temel uğraş alanlarından birisi mezhep içi tercih yoluyla mezhepteki râcih görüşü belirlemek olmuştur. Mukallid kadı ve müftîlerin mezhepteki râcih görüşü bulmalarına yardımcı olmak amacıyla da mezhep içi tercih usûlü bir diğer ifade ile resmüʼl-müftî ortaya çıkmıştır. Hanefî mezhebinde mezhep içi tercih ve usûlünün incelendiği bu tez dört bölümden oluşmaktadır. Birinci bölümde mezhep içi tercihin mâhiyeti tespit edilmeye çalışılmıştır. Bu amaçla mezhep içi tercihin tanımı, türleri, konusu, gayesi incelemiş ve mezhep içi tercih, ictihad, taklid, tahriç ve temyiz gibi diğer fıkhî akıl yürütme türleri ile mukayese edilmiştir. İkinci bölümün konusu mezhep içi tercihin gerekliği ve râcih görüşün bağlayıcılığıdır. Burada müctehid, mukallid fakih ve avam açısından mezhep içi tercihin gerekli ve mezhepteki râcih görüşü bağlayıcı olup olmadığı üzerinde durulmuş, bu gereklilik ve bağlayıcılık düşüncesi temellendirilmeye çalışılmıştır. Üçüncü bölümün amacı mezhep içi tercih usûlünün mâhiyeti tespit etmektir. Bunun için mezhep içi tercih usûlünün/resmüʼl-müftînin muhtevasını oluşturan râcih görüş ilkeleri ile gayesi ve muhâtabı incelenmiştir. Son bölümde ise etkili şahıs ve eserler bağlamında bu usûlün oluşum süreci ele alınmıştır. | tr_TR |
| dc.description.abstract | There are many controversial subjects within the Hanafi School. To be able to judge or to give a fatwa for these subjects, one of opposing views should be preferred to other. Also in order to ensure legal safety and stability it is important to identify which opinions are preferred within a School. Therefore throughout history, one of the main issues Hanafî jurists dealt with was to identify the preferred opinion in the School through the intra-school prefence method. This method (which is called Rasm al-Muftî) appeared in order to help muqallid kâdis and muftis to find the preferred opinion in Hanafî School. This thesis that examined the intra-school preference and its method, consists of four chapters. The first chapter focused on trying to identify the nature of the intra-school preference. For this purpose the definition of the intra-school prefence, its theme, types, and aims have been examined and this method is compared with the other types of juridical reasoning which are tarjih, ictihad, taqlid, takhric and tamyiz. The subject of second chapter is the necessity of the intra-school preference and obligatory of the preferred opinion. Here it is focused on whether intra-school preference is necesary and whether preferrred opinion is obligotory in terms of mujtahid, mukallid, faqih and avam, in addition to this it is tried to give justifications for the notions of necessity and obligatoriness. The aim of the third chapter is to determine the qualification of method of intra-school preference. Hence the principles of the preferred opinion that formed the content of Rasm al-Müftî/the method of intra-school prefence, and purpose of the preferred opinion and its interlocutor have been examined. In the last chapter the formation process of this method have been tackled within the context of effective persons and their works. | en_US |
