Abstract

Kamu istihdam kurumları, 19.yy sonlarında işsizliğin meydana getirdiği sosyo-ekonomik sorunlar sonucu, gelişmiş ülkelerde ortaya çıkmıştır. İş arayanlara uygun iş, işçi arayanlara uygun iş gücü bulmada yardımcı olan ve kar amacı gütmeyen kamu kuruluşları olarak örgütlenmişlerdir. Günümüzde hemen her ülkede kamu istihdam kurumu bulunmakla birlikte, giderek hızlanan teknolojik gelişmeler ve küreselleşme olgusu kamu istihdam kurumlarının tek başına bu gelişmeleri karşılayamaması sonucunu doğurmuş, istihdam hizmetlerinin sunumunda kamu dışında başka hizmet sağlayıcıların da varlığını zorunlu kılmıştır. 1990’lı yıllardaki ekonomik serbestleşme ve küreselleşme ortamında ILO, kamu istihdam kurumlarındaki tekel anlayışını terk etmiş ve iş gücü piyasasının işleyişine olumlu katkılar sağlayacak düzenlemelerle birlikte özel istihdam bürolarını kabul etmiş ve özel istihdam bürolarının düzenlemesinde yol gösterici hükümleri belirlemiştir. Türkiye’de de istihdam hizmetleri bu gelişmelerden etkilenmiş iş gücü piyasasında iş bulma ve işe girme zorlaşmış, işletmeler de işe uygun nitelikte işçi bulma sıkıntısı çekmeye başlamıştır. Her geçen gün artan işsizlik oranları temel görevi; ulusal istihdam politikalarının oluşturulmasına, istihdamın korunmasına ve geliştirilmesine, işsizliğin önlenmesi faaliyetlerine yardımcı olmak olan İŞKUR’un bu taleplere yeterince cevap verememesi, iş ve işçi bulma hizmetlerinin devlet tekelinden çıkması ihtiyacını doğurmuştur. 4857 Sayılı İş Kanunu’nun “İş ve İşçi Bulmaya Aracılık” başlıklı 90. maddesinde, iş ve işçi bulmaya aracılık görevinin İŞKUR ve izin verilen özel istihdam büroları (ÖİB) tarafından yerine getirileceği düzenlenmiştir. Böylece danışmanlık büroları adı altında gayri resmi olarak faaliyet gösteren bu büroların, yasal bir düzenleme çerçevesinde ve belirlenen esaslar içerisinde çalışmaları ve kurum hizmetlerini tamamlayıcı bir konuma gelmeleri sağlanmıştır. Bu çalışmada, istihdamın değişen yapısına bağlı olarak özel istihdam kurumlarının ortaya çıkışı, özel istihdam bürolarına ilişkin Türkiye’deki yasal düzenlemeler ve bu büroların faaliyetlerine ilişkin istatistiki bilgilere yer verilmiştir. Haziran 2004’den 2006 yılı sonuna kadar olan istatistiki bilgiler kullanılarak Türkiye’de özel istihdam bürolarının faaliyetlerine ilişkin bir durum tespiti yapılmaya çalışılmıştır.
Because of the socio-economic problems caused by the unemployment at the end of the 19. century, public employment agencies appeared in developed countries. They werw organized to be non-pofit public aegncies that provided the unemployment with appropriate jobs andprovided the employee seekers with labour. Today there are public employment agencies almost in every country, but the rapid growth in technological improvements and globalization has resulted with the inefficiency of these public employment agencies by themselves which forced the existence of other service providers apart from publicitiy in presentation of employment services. In the environment of economic liberalization and globalization in 1990s, ILO abandoned the mentality of momopoly in public employment agencies and it accepted the private employment agencies together with the reorganizations that would positively support to the process of the labour market and determined the rules in the reorganization of private employment agencies. Employment services in Turkey had been affected by these developments, it had become difficult to find a job in the labour market, companies had difficulty in finding qualified workers. Because of the increasing unemployment rates İŞKUR whose main duties are to form national employment policies, protection and development of employment, help the prevention of unemployment; cannot satisfy the demands and this led to the need for job and labour finding services to break out of govenment monopoly. In the 90. article of labour law numbered 4857 which is named “Interagency in Job and Labour Finding”; the duty of interagency in job and labour finding is organized by İŞKUR and private employment agencies that are allowed. Therefore the agencies which function un officially under the name of consultancy agencies were provided to work in the frame of a legal organization and the rules determined and to reach a complementary level for İŞKUR. In this work, the appearance of private employment agencies depending on the developing structure of employment, the legal organizations about privete employment agencies in Turkey and the statistic data on these agencies' functions are stated. A situational determination on the functions of privete employment agencies in Turkey has been tried to be made with the use of the statistical data till the end of the term from June 2004 to 2006.
