Abstract
Kiralanan taşınmazların 2004 sayılı İcra İflas Kanununa göre tahliyesi, sıkça başvurulan ve uygulamada geniş yer tutan bir müessesedir. Kiralanan taşınmazların, yalnızca iki halde İcra İflas Kanununa göre ilamsız tahliyesine olanak sağlanmıştır. Bunlar kira bedelinin süresinde ödenmemesi ve kira süresinin sona ermesi olarak karşımıza çıkmaktadır. Yalnız bu iki hale özgü olarak, mahkemeden tahliye ilamı alınmaksızın, icra dairesine başvurularak kiralanan taşınmazın ilamsız icra yoluyla tahliyesine olanak tanınmıştır. Kiralanan taşınmazın ilamsız icra yoluyla tahliyesi, sadece para ve teminat alacağına özgü bulunan ilamsız icra müessesesine istisna teşkil etmektedir. Söz konusu ilamsız tahliye yolu, daha hızlı, ucuz ve pratik olması yönünden sıkça tercih edilmektedir. Bu itibarla, kiralanan taşınmazın 2004 sayılı İcra İflas Kanununa göre tahliyesine ilişkin hükümler önem arz etmektedir. Önemine binaen kiralanan taşınmazın İcra İflas Kanununa göre tahliyesi tez konumuz olarak belirlenmiştir. Tez çalışmamızda, kiralanan taşınmazın İcra İflas Kanununa göre tahliyesi konusu, doktrinde yer alan görüşler ve Yargıtay kararları ışığında ele alınmıştır.
The eviction of leased immovables according to the Enforcement and Bankruptcy Law No. 2004 is a frequently resorted to and widely implemented in stitution inpractice. The Enforcement and Bankruptcy Law allows for eviction without a court order in only two circumstances: non-payment of rent within the stipulated period and expiration of the lease term. Specifically limited to these two cases, the possibility of evicting leased immovables through enforcement without obtaining a court decree has been provided by applying to the enforcement office. The eviction of leased immovables through enforcement without a decree constitutes an exception to the enforcement institution, which is specific to monetary and security debts. This particular method of eviction, due to its swiftness, cost-effectiveness, and practicality, is frequently preferred. Therefore, the provisions concerning the eviction of leased immovables according to Law No. 2004 hold significance. Based on its importance, the eviction of leased immovables according to the Enforcement and Bankruptcy Law has been chosen as the subject of our thesis. In our thesis, the eviction of leased immovables according to the Enforcement and Bankruptcy Law is examined in light of the opinions expressed in legal doctrine and the decisions of the Court of Cassation.
