"Risâle tete‘allaku bi-kelâmi’l-beyzâvî fî tercîhâtihî beyne’l-hanefiyye ve’ş-şâfi‘iyye” adlı eserin tahkiki ve İslâm hukuku açısından değerlendirilmesi

Abstract

Bu çalışmada, 15 ve 16. yüzyıllarda yaşamış, İbn Bilâl’in, “Risâle tete‘allaku bi-kelâmi’l-Beyzâvî fî tercîhâtihî beyne’l-Hanefiyye ve’ş-Şâfi‘iyye” adlı eserin tahkiki yapılmıştır. Bu çerçevede müellifin hayatı, ilmi kişiliği ve eserleri tanıtılmaya çalışılmıştır. Çalışma, giriş, üç bölüm ve sonuç kısımlarından oluşmaktadır. Giriş bölümünde araştırmanın konusu, amacı ve kullanılan yöntemle ilgili bilgi verilmiştir. Birinci bölümde müellifin hayatı, ilmi kişiliği ve yaşadığı döneme dair bilgiler sunulmuştur. İkinci bölümüde eserin genel bir tanıtımına yer verilmiştir. Bu bölümde ayrıca eserin ismi, müellife aidiyeti, nüshanın özellikleri, muhtevası ve önemi gibi çeşitli konulara değinilmiştir. Üçüncü bölümde Türkiye’de ve İslâm âleminde kullanılan tahkik yöntemlerine istinat edilerek adı geçen eserin tahkik çalışması yapılmıştır. Çalışmamızda İslâm Araştırmaları Merkezi’nin (İSAM) tahkik konusunda belirlediği kurallar dikkate alınmıştır. Sonuç bölümünde ise yapılan tahkik çalışmasından elde edilen sonuçlar özetlenmiştir.

In this study, a Risāla penned by İbn Bilâl who lived between 15th and 16th centuries has been investigated. The writer’s life, scientific identity and other works have been introduced as well. The study consists of an introduction, three chapters and a conclusion. In the introduction, information on the subject, purpose and method of the research is given. In the first chapter, information about the author's life, his scientific personality and the period he lived is presented. In the second part, a general introduction to the Risala is given. In this section, various subjects such as the name of the work, its belonging to the author, the characteristics of the copy, its content and its importance are discussed. In the third chapter, the aforementioned works were investigated based on the investigative methods used in Turkey and in the Islamic world. In addition, in our study, the rules determined by the Center for Islamic Studies (ISAM) in matters of verification were taken into account. In the concluding part the results obtained from the investigative study are summarized.
