Ronald Dworkin’in eşitlik düşüncesi ve liberalizme etkisi

Abstract

Bu çalışmada temel olarak, ünlü hukuk ve siyaset felsefecisi Ronald Dworkin’in eşitlik düşüncesi ve bu bağlamda eşitlik düşüncesinin liberalizme etkisi ele alınmaktadır. Üç ana bölümden oluşan bu çalışmanın birinci bölümünde, bir kavram olarak ‘eşitlik’ incelenmekte ve tarihsel süreçte düşünürlerin eşitlik kavramına dair düşünceleri ve yaklaşımları ele alınmaya çalışılmaktadır. Yine bu bağlamda Antik Yunan’dan günümüze kavramın gelişimi incelenmekte ve eşitlik tiplerine değinilmektedir. Çalışmanın ikinci bölümünde ise liberal teorinin kökeni incelenerek; liberal teorinin ilkelerine, türlerine ve liberalizmin genel olarak eşitlik düşüncesine bakışı ele alınmaktadır. Üçüncü ve son bölümde ise öncelikle Dworkin’in hukuk felsefesine kısaca değinilerek, kendisinin bireyin en temel hakkı olarak nitelediği ‘eşit ilgi ve saygı hakkı’ düşüncesinden hareketle, ‘refah eşitliği’, ‘kaynak eşitliği’ ve politik eşitliğe dair düşünceleri ele alınmaktadır. Dworkin’in ‘eşit ilgi ve saygı hakkı’ bağlamında eşitliğe yönelik yaptığı vurgu ile liberalizme etkisi tartışılmaktadır. Yine Dworkin’in eşitliğe verdiği önem doğrultusunda onun liberalizmin sosyal kanadında yer almasına değinilmektedir.

In this study, the idea of equality of the famous law and political philosopher Ronald Dworkin and the effect of equality to liberalism are discussed. This study consists of three main parts. In the first part, ‘equality’ is examined as a concept, and the thoughts and approaches of thinkers about the concept of equality are tried to be discussed in the historical process. In this context, the development of the concept from Ancient Greece to the present has been examined, and equality types have been mentioned. In the second part of the study, by analysing the origins of liberal theory, the principles of liberal theory, the types of liberalism and the idea of equality of liberalism, in general, are discussed. In the third and final chapter, first of all, Dworkin's philosophy of law is mentioned briefly, and his thoughts on ‘equal concern and respect’ which he defines as the most fundamental right of the individual are analysed. Dworkin's emphasis on equality in the context of ‘the right to equal concern and respect' and its impact on liberalism are discussed. In line with Dworkin's emphasis on equality, his involvement in the social wing of liberalism is mentioned.
