Abstract
Şüf’a hakkı; bir akde konu olan, satılmış bir taşınmazın aynı bedelle ve satıcının rızasına bakılmaksızın mülk edinilmesidir. Fakat bunun gerçekleşebilmesi için paydaşlık, komşuluk ve irtifak gibi birtakım sebeplerin varlığı gerekmektedir. Hakkın kullanılabilmesi için gereken ise geçerli bir satışın olmasıdır. Şüf’a hakkı Türk Hukuku’nda ‘ön alım’ kavramıyla ifade edilir. Paydaşlıktan doğan yasal ön alım hakkı ve sözleşmeden doğan ön alım hakkı olmak üzere iki başlıkta incelenir. Ön alım hakkı, Türk hukukuna kıyasla İslâm hukukunda çok daha geniş bir kapsama sahip olsa da özü itibariyle amacı yabancıdan gelebilecek zararın önlenmesi ve ferdi mülkiyetin yaygınlaştırılmasıdır.
The right to Suf’a is the acquisition of property at the same price and regardless of the vendor's consent, which is a subject of a contract. But to make that happen, there are several reasons, such as stakeholders, neighborhood and easement. The job required to use the right is to have a valid sale. The right to Suf’a is expressed in Turkish Law with the concept of ‘priority purchase right’. It is reviewed in two headings, the right to legal priority purchase arising from the stakeholder and the right to receive priority purchase from the contract. Priority purchase right, to consent has much wider coverage in İslâmic law than Turkish law, it is essentially the prevention of damage from that may arise foreigners and the proliferation of individual property.
