Osmanlı dönemi fetva mecmualarında ceninle ilgili hükümler

Abstract

“Osmanlı Dönemi Fetva Mecmualarında Ceninle İlgili Hükümler” adlı çalışmamız, 17-19. yüzyıl Osmanlı hukukuna ait temsil gücü yüksek bazı fetva mecmualarının incelenerek ceninle ilgili fetvaları tespit ve tahlil amacıyla yapılan bir çalışmadır. Tezimiz, bir giriş ve iki bölümden oluşmaktadır. Birinci bölümde, ceninin anne karnındaki oluşumunun hukuki açıdan önemi belirtilip nasslar ve tıbbi veriler ışığında açıklanmaktadır. İkinci bölümde ise,Osmanlı fetva literatüründen ceninin yaşam, nesep, miras, vasiyet ve vakıfla ilgili hakları, ıskât-ı cenin ve ceninin iddet ile ilişkisi konuları incelenmiştir. Son olarak, çalışmanın değerlendirilmesi yapılmış olup gerekli fetvaların güncel halleri zikredilmiştir.

Our thesis titled “Provisions Regarding Fetus in Ottoman Period Fatwa Collections”, is a study conducted to identify and analyze fetal fatwas by examining some outstanding fatwa journals belonging to the 17th-19th century Ottoman law. Our study consists of an introduction and two parts. In the first part, the legal importance of the formation of the fetus in the mother's womb is stated and explained in the light of texts and medical data. In the second part, the rights of the fetus related to life, lineage, inheritance, testament, foundation, abortion and the relation between fetus and iddah from Ottoman fatwa literature were examined. Finally, the evaluation of the study has been made and the current versions of the necessary fatwas are mentioned.
