Kur’ân’da geçen siyasî kavramların fıkhî açıdan tahlili

Abstract

Sosyal bir varlık olan insanın yaşam biçiminin düzenlenmesi ve sosyal hayatın sorunsuz şekilde sürdürülebilmesi için gerekli kuralların üretilmesi ve uygulanması olarak özetlenebilecek siyaset kavramı, İslam’ın üzerinde önemle durduğu kavramlardan biridir. Özellikle yeni bir toplum inşa etme iddiasıyla ortaya çıkan İslam dini, müslümanların gerek kendi aralarında gerekse de diğer din müntesipleriyle ilgili olarak yaşam biçimini düzenlemeye yönelik evrensel ilkeler ortaya koymuştur. Bu çalışmada İslam toplumunun temel kaynağı olan Kur’ân’da geçen siyasî kavramlar İslam fıkhı ışığında tahlil edilmiştir. Bu bağlamda Kur’ân’da geçen siyasî kavramlar öncelikle iç ve dış siyasetle ilgili kavramlar olmak üzere iki ana bölümde incelenmiş ardından da ulu’l-emr, halîfe, bey’at, şûra ve emri bi’l-marûf, barış, emân, cizye, esîr, ganimet gibi tali başlıklar altında her birisi ele alınmıştır. Üçüncü bölümde ise adalet ilkesi ile cihât kavramları detaylıca incelenmiş, adaletin esasları, toplumsal ve bireysel adalet, cihadın amacı, hükmü, cihad ile harb ve terörizm arasındaki farklar, gibi konular fıkhî açıdan irdelenmiştir.The term ‘politics’ can be defined as ‘the art of making laws that are necessary to regulate the life of human -who is a social being- and to maintain the smooth sailing of social life’. It is a prominent notion to which Islam attaches great importance. Islam, the religion that aims to build a new type of society, has set universal principles regarding both the interrelations of Muslims and the relations of Muslims with nonmuslims. This paper analyzes the political terms mentioned in the fundamental source of Islam, that is, the Quran, in the light of Islamic jurisprudence (fiqh). In this paper, we have first classified the political terms mentioned in the Quran into two groups as related to domestic policy and foreign policy. Then, each term, such as, “ulu’l emr”, “khalifah”, “bey’at”, “shura”, “al-emr bi’l ma’ruf”, “peace”, “al-amaan”, “jizyah”, “captive”, “spoils”, etc. is studied under an individual subsection. In the third chapter, the principle of justice, the terms “safarah”, and “messengership” are addressed. We have thoroughly examined the fundamentals of justice, social and individual justice, functions of messengership, main duties of messengers, and the points to consider in choosing messengers from the viewpoint of Islamic jurisprudence in this chapter.
