Özet
Bu tez, mikrofinans ve İslami mikrofinans sistemlerinin yapısını, işleyişini ve etkilerini analiz ederek, Bangladeş’teki yasal düzenleme çerçevesine yönelik Hindistan ve Pakistan ile karşılaştırmalı bir değerlendirme sunmayı amaçlamaktadır. Bangladeş, mikrofinansın küresel çapta yayılmasında önemli bir rol oynamış olup, özellikle Grameen Bank modeli ile mikrofinans uygulamalarını büyük bir başarıyla hayata geçirmiştir. Son yıllarda, İslami mikrofinans hem Bangladeş'te hem de diğer ülkelerde geleneksel mikrofinansa alternatif olarak sosyo-ekonomik kalkınmaya önemli katkılarda bulunmuştur. İslami mikrofinansın bu yapısı, özellikle yoksullara yönelik fırsatlar sunmaktadır. Bangladeş’te mikrofinans dört aşamada gelişim göstermiştir: deney ve yenilik, kurumsallaşma, büyüme ve olgunluk. Bu süreçte kırsal kalkınma, kadınların güçlendirilmesi ve yoksullukla mücadelede önemli başarılar elde edilmiştir. Çalışmada, Bangladeş Mikrofinans Düzenleme Kurumu (MRA) çerçevesinde mevcut yasal düzenlemeler analiz edilmiştir. Ayrıca, Bangladeş’teki düzenleyici çerçeve Hindistan ve Pakistan ile kıyaslanarak değerlendirilmiştir. Buna göre Bangladeş’te geleneksel mikrofinansa yönelik kapsamlı bir düzenleme yapısı mevcutken İslami mikrofinans açısından sınırlı bir yapı söz konusudur. Diğer yandan Hindistan’da geleneksel mikrofinans daha üst seviyede gelişmişken Pakistan’da ise İslami mikrofinansa yönelik düzenleme daha kapsamlıdır.
This thesis aims to provide a comparative assessment of the legal framework in Bangladesh with India and Pakistan by analyzing the structure, functioning and impacts of microfinance and Islamic microfinance systems. Bangladesh has played an important role in the spread of microfinance globally and has successfully implemented microfinance applications, especially with the Grameen Bank model. In recent years, Islamic microfinance has made significant contributions to socio-economic development both in Bangladesh and other countries as an alternative to conventional microfinance. This structure of Islamic microfinance offers opportunities especially for the poor. Microfinance in Bangladesh has developed in four stages: experimentation and innovation, institutionalization, growth and maturity. During this process, significant achievements have been achieved in rural development, women's empowerment and poverty alleviation. In this study, the existing legal regulations within the framework of the Bangladesh Microfinance Regulatory Authority (MRA) have been analyzed. In addition, the regulatory framework in Bangladesh has been evaluated in comparison with India and Pakistan. Accordingly, while there is a comprehensive regulatory structure for conventional microfinance in Bangladesh, there is a limited structure in terms of Islamic microfinance. On the other hand, while conventional microfinance is more developed in India, the regulation of Islamic microfinance is more comprehensive in Pakistan.
