Hanefî fıkıh usûlünde şart kavramı ve fürû-i fıkıhta uygulaması

Abstract

Fıkıh usûlünün konusu olan şer'î hüküm birtakım kavramlar üzerine temelledirilmektedir. Bunlardan biri de hükmün varlığının bir yönüyle kendisine bağlandığı şart kavramıdır. Çalışmanın amacı bu kavramı Hanefî bakış açısıyla şer'î / vaz'î bir hüküm olarak usûl-fürû-i fıkıh ilişkisini dikkate alan bir yaklaşımla incelemek ve bu çerçevede yürütülen hukuk mantığını ortaya koymaktır. Araştırmada literatür taraması yapılmıştır. Tezin birinci bölümünde şart kavramının şer'î / vaz'î yönünü ortaya koyabilmek için öncelikli olarak şer'î hüküm teorisi genel hatlarıyla ele alınmış; hükmün tanımı, tasnifi ve kaynakları incelenmiştir. Akabinde fukâha metoduyla yazılan usûl literatüründe şart ve ilgili kavramların analizi ve tasnifi yapılmıştır. İkinci bölümde de şartla ilgili usûl meseleleri Hanefî hukuk bakış açısıyla bir araya getirilerek incelenmiştir. Üçüncü bölümde ise teorik düzlemde işlenen şartla ilgili usûl kâidelerinin fürû-i fıkıhta nasıl tatbik edildiği ve yorumlandığı fer'î örnekler üzerinden mülahaza edilmiştir. Sonuç olarak usûlde farklı bağlamlarda birçok meselenin içerisinde ele alınan şart kavramına dair birtakım kâideler tahric edilmiştir. Tahric edilen bu kâidelerin bazısının fürû-i fıkıhta şer'î gayelerin tahakkuku doğrultusunda esnetilirken bazısının katı bir şekilde tatbik edildiği ve bazılarının da dilin vaz'ının gereğiyle sınırlandırıldığı görülmüştür. Son tahlilde ortaya çıkan bu farklılık usûl-fürû arasında bir çelişki değil bilakis hukuk mantığı içerisinde tabii bir durum olarak yorumlanmıştır.

The Concept of Condition in Hanafi Fiqh Methodology and Its Application in the Furû al-Fiqh Sharia judgment, which is the basic subject of fiqh procedure, is based on some concepts. One of these is the concept of condition, which is connected to the existence of the ruling in one way. The aim of the study is to examine this concept from the Hanafi law perspective as a shari'a / vaz'i provision together with the procedure and furû and to reveal the legal logic implemented within this framework. The method used in the research is literature review. In the first part of the thesis, in order to reveal the shari'a / vaz'i aspect of the concept of condition, the theory of shariah provision is discussed in general terms; the definition, classification and sources of the ruling were examined. Subsequently, the concept of condition and related concepts were analyzed and classified in the Usûl literature written with the Hanafi jurists' method. In the second part, the Usûl issues that the condition falls under were brought together and examined from the perspective of Hanafi law. In the third part, how the Usûl rules related to the condition, which were processed on a theoretical level, were applied / interpreted in the Furu-i Fiqh were considered through secondary examples. As a result, some rules have been issued regarding the concept of condition, which is discussed in many issues in different contexts in the procedure. While some of these established rules were relaxed in line with the realization of shariah aims in the fiqh, some of them were strictly applied. Some have remained limited to the requirements of the language. In the final analysis, this difference was interpreted as a natural situation within the logic of law, not as a contradiction between procedural fiqh and furu fiqh.
