2004 Sayılı İcra ve İflas Kanunu’nun (İİK) 168. maddesinde icra müdürüne kambiyo senedini inceleme yetkisi verilmiştir. Buna göre icra müdürü bir kambiyo senetlerine mahsus icra takibi başlatırken önüne sunulan senedin, kambiyo senetlerine mahsus takip yolu ile icra edilip edilmeyeceğini denetlemesi gerekmektedir. İİK’nın 168. maddesinde icra müdürüne denetim yapmak üzere verilen bu yetki, kambiyo senedinin zorunlu unsurlarının bulunup bulunmadığı ve kambiyo senedinin vadesinin gelip gelmediğini denetim yetkisidir. İcra müdürü bu denetimi akabinde senedin kambiyo senedi vasfında olduğuna karar verir ve vadesinin geldiğini tespit ederse, borçluya hemen bir ödeme emri gönderir. Bu ödeme emrinin türleri, kambiyo senetlerine mahsus haciz yolu ile takipte ödeme emri ve kambiyo senetlerine mahsus iflas yolu ile takipte ödeme emrinden oluşmaktadır. Bu çalışmanın konusunu, icra müdürünün kambiyo senetlerine mahsus icra takiplerinde kambiyo senedini inceleme yetkisi oluşturmaktadır. Kambiyo senetleri, bu tür takiplerde ehliyet, takip başlatırken kambiyo senedi ile hangi evrakların icra dairesine teslim edileceği ve icra takip talebinde bulunması gereken hususlar yine bu çalışmanın içerisinde açıklanacaktır.
Article 168 of the Enforcement and Bankruptcy Law No. 2004 grants the enforcement officer the authority to examine the promissory note. Accordingly, when initiating enforcement proceedings specific to negotiable instruments, the enforcement officer is required to review whether the presented promissory note qualifies for enforcement through the procedure exclusive to such instruments. The authority conferred by Article 168 of the Enforcement and Bankruptcy Law enables the enforcement officer to verify whether the mandatory elements of the promissory note are present and whether the note has reached its maturity date. If the enforcement officer concludes, following this examination, that the instrument qualifies as a promissory note and that it has matured, they must immediately issue a payment order to the debtor. This payment order may take the form of either: a payment order through the attachment procedure specific to negotiable instruments, or a payment order through the bankruptcy procedure specific to negotiable instruments. The focus of this study is the enforcement officer’s authority to examine the promissory note in enforcement proceedings specific to such instruments. It will also explain how procedural capacity is determined in enforcement proceedings specific to negotiable instruments, what documents must be submitted to the iv enforcement office when initiating such proceedings, and the essential elements that must be included in the enforcement request.
