A research on the scope of Mustafa Ahmad al-zarqa's book project named al-fiqh al-İslami fi thawbih al-jadid

Abstract

In this article, we tried to determine what the fourth volume of Mustafa Ahmed al-Zarqa's book project named al-Fiqh al-Islami fi thawbih al-jadid. As a method, we interpreted the preface of the books published by the author within the scope of the project, comparatively with the content of the books. As a result of this examination, it was concluded that the fourth volume of this project which planned in the beginning, it was replaced by the law design named "Nususu mavadd al-nazariyyah al-ammah li al-iltizamat fi al-fiqhi al-Islami" which added to the third volume in the new edition of the work, in a different form from the original plan. It is also argued the justice of this argument by analyzing the content relationship between the working name and that law design. This law project is an important element both regarding being able to appreciate Zarqa's work more accurately and in the next stage in the process of making law based on Islamic jurisprudence.
