Türk hukukunda konut kapıcılığı

Abstract

Konut kapıcılığı sanayileşmenin gelişmesiyle birlikte ortaya çıkmış modern yaşamın bir parçası haline gelmiş meslek gruplarından birisidir. Kapıcılık mesleğinin yaygınlaşmasıyla birlikte bu alanda hukuki düzenleme yapmak bir zorunluluk halini almıştır. Esasen bir işçi olan kapıcılar farklı düzenlemelere tabi olmayı gerektirecek kendine has özelliklere sahip bir meslek grubunda yer almaktadır. Bu nedenle çalışmamızda bir takım özel durumlara dikkat çekilmek suretiyle 4857 sayılı İş Kanunu ve Sosyal Güvenlik Hukuku kapsamında konut kapıcılığı anlatılmıştır. Tez çalışmamızda 931 sayılı, 1475 sayılı ve nihayet 4857 sayılı İş Kanunu Kapsamında konut kapıcıları ele alınarak geçmişten bugüne yapılan değişikliklerle birlikte konut kapıcılarının hukuki durumu ele alınmıştır. Bu kapsamda birinci bölümde konut kapıcılığından söz edilerek ülkemizde geçirdiği aşamalar ele alınmış ve İş Kanunu’nun konut kapıcılarına ne şekilde ve nasıl uygulanacağı açıklanmıştır. Bu bölümde konut kapıcılarının çalışma hayatı üzerinde durularak İş Kanunu kapsamında özellik arz eden noktalarla birlikte açıklamalar yapılmıştır. Bununla birlikte kapıcılık sözleşmesinin kurulması hüküm ve sonuçları ve ortaya çıkardığı birtakım neticeler işlenmiştir. İkinci bölümde ise, konut kapıcılığı sözleşmesinin sona ermesi ve bunun neticesinde özellik arz eden birtakım konular üzerinde durulmuştur. Son bölümde ise kapıcıların sosyal güvenlik hakları üzerinde durularak çalışma tamamlanmıştır.

Housing janitorship is one of the professional groups that have emerged with the development of industrialization and have become a part of modern life. With the spread of the janitorial profession, it has become a necessity to make legal arrangements in this field. Janitors, who are essentially a worker, are workers with their own characteristics that require to be subject to different regulations. For this reason, in our study, housing janitorship was explained within the scope of the Labor Law No. 4857 and the Social Security Law by drawing attention to a number of special situations. In our thesis study, the legal situation of housing janitors has been discussed with the changes made from the past to the present by considering the housing janitors within the Scope of the Labor Law No. 931, No. 1475 and finally No. 4857. In this context, in the first chapter, the stages of housing janitorship in our country are discussed by mentioning and it is explained how and how the Labor Law will be applied to housing janitors. In this section, explanations have been made with the emphasis on the working life of housing janitors along with the points that are specific within the scope of the Labor Law. However, the provisions and consequences of the establishment of the janitorial contract and some of the consequences it has brought about have been processed. In the second part, the termination of the housing janitorship contract and a number of issues that are characteristic as a result of this are focused on. In the last section, the study was completed by focusing on the social security rights of janitors.
