Suçta ve cezada kanunilik ilkesi bağlamında terör örgütüne üye olma suçu

Abstract

Bu çalışmanın konusu, ceza hukukunda yaygın bir şekilde uygulama alanı bulan terör örgütüne üye olma suçunun suçta ve cezada kanunilik ilkesi çerçevesinde incelenmesidir. Terör örgütüne üye olma suçuna ilişkin mevzuatta ve uygulamada karşımıza çıkan ve belirsizliğe yol açma potansiyeli taşıyan temel sorunları tespit amacı taşıyan bu çalışmanın ilk bölümünde terör örgütüne üye olma suçunun terör ve örgüt unsuruna açıklık getirebilmek amacıyla terör, terörizm, örgüt, örgütlü suçluluk ve terör örgütü kavramları ele alınmıştır. İkinci bölümde suçta ve cezada kanunilik ilkesi ile onun en önemli alt ilkelerinden birisi olan belirlilik ilkesi teori ve uygulama açısından incelenmiştir. Üçüncü bölümde terör örgütüne üye olma suçunun tarihsel gelişimi, genel özellikleri ve unsurları ele alınmıştır. Dördüncü ve son bölümde ise terör örgütüne üye olma suçuyla suçta ve cezada kanunilik ilkesi ilişkisi üzerinde durulmuş, terör kavramının iç hukuktaki tanımının belirlilik ilkesini karşılayıp karşılamadığı, yargısal yorumların ve çeşitli yüksek mahkeme kararlarında ortaya konulan kriterlerin ve terör örgütüne üye olma suçu bakımından yeterince açık ve öngörülebilir kabul edilip edilemeyeceği ortaya konulmaya çalışılmıştır.

The subject of this study is to examine the crime of being a member of a terrorist organization, which is widely applied in criminal law, within the framework of the principle of legality. In the first chapter of this study, which aims to identify the key issues in the legislation and practice related to the crime of membership in a terrorist organization that may lead to ambiguity, the concepts of terror, terrorism, organization, organized crime, and terrorist organizations are examined in order to clarify the elements of terror and organization of the crime of being a member of a terrorist organization. In the second chapter, the principle of legality, along with the principle of certainty, which is one of its most significant subprinciples, is examined from both theoretical and practical perspectives. In the third chapter, the historical development, general characteristics, and elements of the crime of being a member of a terrorist organization are analyzed. In the fourth and final chapter, the relationship between the crime of membership in a terrorist organization and the principle of legality is discussed, whether the definition of terrorism in domestic law meets the principle of certainty, and whether judicial interpretations and the criteria established in various high court rulings can be considered sufficiently clear and foreseeable in the context of of the crime of being a member of a terrorist organization.
