Suça sürüklenen çocukların soruşturma evresi

Abstract

Çalışmamızda suça sürüklenen çocukların soruşturma evresi incelenmiştir. Bu manada çocuk kavramı, çocuk hukukunun gelişim süreci, soruşturma evreleri, çocuklar için oluşturulan yargılama mercileri ele alınmıştır. Ayrıca koruma tedbirleri, koruyucu ve destekleyici tedbirler ve soruşturmayı sona erdiren sebepler önce ana hatlarıyla anlatılmış, daha sonra çocuklar açısından, çocuklara özgü düzenlemeler ışığında incelenmiştir. Bu incelemelerde başta Çocuk Koruma Kanunu ve Türk Ceza Kanunu olmak üzere çocuklarla ilgili ulusal ve uluslararası birçok düzenlemeye yer verilmiştir. Doktrin ve uygulamadaki farklılıklar ele alınmış ve Yargıtay kararlarıyla konunun içeriği zenginleştirilmiştir.

Our study examined the investigation phase of the children dragged into crime.Our study discusses the concept of child, the development process of juvenile law, thestages of investigation, and the jurisdictions established for children. However,protection measures, protective and supportive precautions, and the reasons for endingthe investigation were first outlined and then examined in terms of children in the lightof child-specific regulations. In these reviews, many national and internationalregulations related to children, especially the Child Protection Law and the TurkishPenal Code, were included. Differences in doctrine and practice have been discussedand the content has been enriched with the Supreme Court decisions.
