“Size farz kılınmasından korkmasaydım…” şeklinde nakledilen hadislerin değerlendirilmesi

Abstract

Kuran’daki genel hükümlerin detaylarını açıklamada, sınırlarını belirlemede, detaylarıyla anlatılan hükümleri uygulamada, tarif etmede, anlaşılmayan kısımları aydınlatmada ve tefsir etmede Hz. Peygamber (sav), kaçınılmaz ve inkar edilmez bir görev üstlenmiştir. Bunun yanı sıra Hz. Peygamber’in (sav), geçmişten günümüze tartışma konusu olsa da Kuran’da bulunmayan meseleler hakkında hüküm koyma gibi bir yetkisi ve görevi de vardır. Hz. Peygamber’in (sav) Kuran dışı vahiy aldığı ve teşri yetkisinin varlığı ön kabulüyle hazırlanan bu tez, Hz. Peygamber’in (sav)vazetmekten caydığı hükümlerin değerini sorgulayarak konuyu bir adım ileriye taşıma gayesindedir. Çalışma, genel olarak başlıkta belirtilen formda nakledilen hadislerin tespitini ve mana olarak yakın bulunan hadislerle birlikte tahlilini konu edinmektedir. Giriş bölümünde, araştırmanın konusu, amacı, yöntemi, metodu, kaynakları ve öneminden bahsedilmektedir. Birinci bölümde, Hz. Peygamber’in (sav)hüküm koyma yetkisi ile bu hükümlerin geçen zamana ve değişen faktörlere göre gelişen farklı algılanış biçimleri ortaya konmaktadır. İkinci bölümde, başlıkta belirtilen formdaki hadisler şerhlerdeki yorumlarıyla birlikte sıralanmakta daha sonra bu hadislerin teşri değeri belirlenmeye çalışılmaktadır. İkinci bölümün sonunda ise bu hadislerin mana bakımından farklı ilimlerle ilişkili değerlendirmesi yapılmaktadır. Sonuç bölümünde de çalışma boyunca ulaşılan bulgular değerlendirmeye tabii tutularak aktarılmaktadır.

The Prophet (pbuh) has undertaken an inevitable and undeniable task with explaining the details of the general provisions in the Qur'an, determining its limits, applying them, describing the provisions explained in detail, enlightening and interpreting the incomprehensible parts of it. In addition, Prophet (pbuh) also has the authority and duty to make judgements about issues that are not found in the Qur'an, although it is the subject of discussion from past to present. This thesis, which was prepared with the presupposition of that the Prophet (pbuh) received non-Qur'anic revelation and has an authority to impose provisions, aims to take the issue one step further by questioning the value of the provisions that the Prophet (pbuh) has choose not to rule in. The research generally discusses the determination of the hadiths conveyed in the form specified in the title and their analysis together with the hadiths with a close meaning. In the introduction section, the subject, purpose of the study, used method, resources and importance of the research are mentioned. In the first part, with the authority of the Prophet (pbuh) to make adjudication, different ways of perception of these provisions that develop according to the time and changing factors are revealed. In the second part, the hadiths in the form specified in the title have been listed with their interpretations found in the Sharh (commentary) literatüre and then the juidical value of these hadiths were tried to be determined. Also, at the end of the second chapter, these hadiths were evaluated in terms of meaning relation to different sciences. In the conclusion section, the findings obtained throughout the study were conveyed together with their evaluations.
