Malullük sigortası

Abstract

İnsanlar hayatları boyunca; hastalık, yaşlılık, işsizlik, malullük, iş kazası ve daha birçok şekilde risklere maruz kalarak yaşamlarını devam ettirebilmektedir. Bu risklerden, her insanın başına gelebilecek olan malullük, geçmiş zamanlardan günümüze dek insanlık tarihinde niteliğini önemle korumuştur. Farklı toplum grupları tarafından bu riski barındıran bireylerin, yaşadıkları dünyaya ve çevreye adapte olabilmeleri için gerek yasal gerek geleneksel metotlarla muhtelif biçimlerde yardımların yapıldığı ve bu bireyler hakkında koruyucu tedbirlerin alınmış olduğu bilinmektedir. Ülkemizde malullük, sosyal güvenlik bağlamında çeşitli yasa ve yönetmeliklerle düzenleme altına alınmış olup malul kişiler, müspet hukuktaki mevcut bu düzenlemeler kapsamında koruma altına alınmış ve kendilerine birtakım yardımların yapılacağı düzenlenmiştir. Hukukumuzda malullük kavramı ile Kanun uyarınca sigortalı olarak kabul edilen ve yine mevzuatta düzenlenmiş olan hükümler kapsamında malul kabul edilebilecek oranlarda engeli haiz olan, bu engel hâlinin kişinin çalışma gücünde veya meslekte kazanma gücünde kayba neden olduğu, yasal yollarla alınması öngörülmüş sağlık raporları doğrultusunda tespit edilen, fiziki ve/veya ruhani anlamda sakatlık ve arızalara maruz kalmış kişinin içinde bulunduğu maluliyet durumu olarak açıklanmaktadır. 5510 Sayılı Sosyal Sigortalar ve Genel Sağlık Sigortası Kanunu'nun hukukumuza dâhil edilmesiyle Kanun'un düzenlediği sair kurumlarla birlikte malullük de sosyal güvenliğin tek çatı altında toplanmış olması hedefi doğrultusunda şekillenmiştir. Çalışma içerisinde ekseriyetle, uygulanmakta olan 5510 sayılı Kanun hükümleri değerlendirilecek olup ilgili bölümlerde, Kanun'un yürürlüğü öncesinde ve geçiş hükümleri uyarınca uygulanmakta olan diğer Kanunların önem taşıyan noktalarına da değinilecektir. Söz konusu bu çalışmada; sosyal güvenlik hakkından ve kavramından, sosyal güvenlik kapsamında Türk Hukuku'nda ve uluslararası hukukta yapılmış olan düzenlemelerden, malullük ve malullük sigortası kavramlarından, malullüğün türlerinden, malullük sigortası ile sigortalıya sağlanabilecek malullük aylığından ve öngörülen diğer yardımlardan, bu yardımların kazanılmasındaki şartlardan ve geçirilecek olan süreçten, kimi konu başlıkları altında malullüğün, uluslararası boyuttaki düzenlenme şekillerinden ve nihayet, malullük sigortası kapsamında açıklanmasını yerinde gördüğümüz sair hususlardan bahsedilerek inceleme altına alınan konunun, gerekli görülen ayrıntıları ve aynı şekilde, uygulamadaki mevcut veya ortaya çıkabilecek olan birtakım sorunları üzerinde durulmuş ve bu sorunlara çözümler üretilmeye çalışılmıştır.

People can continue their lives by being exposed to risks such as illness, old age, unemployment, disability, work accidents and many other forms throughout their lives. Among these risks, disability, which can happen to anyone, has maintained its importance in human history from past times to the present. It is known that individuals with this risk are provided with various forms of assistance, both legally and through traditional methods, by different social groups in order to adapt to the world and environment they live in, and that protective measures have been taken for these individuals. In our country, disability is regulated by various laws and regulations in the context of social security, and disabled people are protected within the scope of these existing regulations in positive law and it is regulated that they will be provided with certain assistance. In our law, the concept of disability is explained as the disability status of a person who is considered insured according to the Law and who has a disability at a rate that can be considered disabled within the scope of the provisions regulated in the legislation, and who is subject to physical and/or mental disabilities and malfunctions as determined in accordance with the health reports foreseen to be obtained through legal means, where this disability causes a loss in the person's working capacity or earning power in the profession. With the inclusion of the Social Insurance and General Health Insurance Law No. 5510 into our law, disability, along with other institutions regulated by the Law, has been shaped in line with the goal of gathering social security under a single roof. In this study, the provisions of the Law No. 5510 that are currently in effect will be evaluated, and in the relevant sections, the important points of other Laws that were in effect before the Law came into effect and in accordance with the transitional provisions will also be mentioned. In this study, the right and concept of social security, the regulations made in Turkish and international law within the scope of social security, the concepts of disability and disability insurance, the types of disability, the disability pension that can be provided to the insured with disability insurance and other foreseen aids, the conditions for gaining these aids and the process to be gone through, the ways in which disability is regulated internationally under some headings and finally, other issues that we deem appropriate to be explained within the scope of disability insurance, and the necessary details of the subject under examination and similarly, some existing or potential problems in practice have been emphasized and solutions have been tried to be produced for these problems.
