Ceza hukukunda tipiklik hatası

Abstract

Bu çalışmanın konusu, ceza sorumluluğu açısından önemli bir hata türü olan tipiklik hatasıdır. Tipiklik hatası, kasıtlı fiil nedeniyle cezalandırmayı olanaksız kılması nedeniyle ceza sorumluluğu üzerinde oldukça önemli bir etkiye sahiptir. Dolayısıyla kapsamlı bir çalışmayı gerektirmektedir. Bu gerekliliği karşılamak üzere yapılan bu çalışma üç bölümden oluşmaktadır. İlk bölümde, ceza hukukunda hata kurumu ile tipiklik hatasına ilişkin bazı kavram ve konular genel olarak ele alınmıştır. İkinci bölümde, tipiklik hatasının hata öğretisi içindeki sınırları tespit edilerek kast açısından önemsiz hata durumlarından nasıl ayrılacağı ortaya konmuştur. Üçüncü bölümde ise, tipiklik hatasına ilişkin özellik arz eden konular ele alınmıştır.

The subject of this study is mistake on type of crime, which is an important type of mistake in terms of criminal responsibility. Mistake on type of crime has a very significant impact on criminal responsibility, as it makes it impossible to punish for intentional act. Therefore, it requires a comprehensive study. This study, conducted to meet this requirement, consists of three chapters. In the first chapter, some concepts and issues related to the institution of mistake and mistake on type of crime in criminal law are generally discussed. In the second chapter, the boundaries of the mistake on type of crime within the mistake doctrine are determined and how it can be distinguished from irrelevant mistake cases in terms of intent is presented. In the third chapter, specific issues regarding the mistake on type of crime are discussed.
