Bangladeş medenı̇ hukukunun gelı̇şı̇mı̇ ve İslam hukuku açısından değerlendı̇rı̇lmesı̇

Abstract

Hukuk, toplumda barış ve refahın sağlanması için kurumlmuş olan sistemlerden biridir. Tezimizde inceleme konusu yapacağımız Bangladeş dünya haritasında küçük bir ülke olmasına rağmen, 160 milyon nüfusunun % 90.4'ü müslüman ülkedir. Bangladeş'in medeni hukuk kanunlarında müslüman halklara yönelik kanunlar uygulanmaya devam etmektedir. Bu çalışmamız Bangladeş’te yürülükte olan medenin hukukun tarihsel gelişimi ve İslâm hukukuna göre değerlendirilmesi için hazırlanmıştır. Bu çalışmada, Bangladeş'in siyasi ve coğrâfî yapısı, dini nüfusu ve İslamlaşması hakkında genel bilgiler verildikten sonra Bangladeş’teki hukuk sisteminin tarihsel gelişimi dönemler halinde incelenmiş ve Bangladeş'teki medeni hukuk sistemi İslam hukuku açısından değerlendirilmiştir.Law is one of the systems established to ensure the peace and welfare in the society. We will discuss in our thesis about Bangladesh, which is a small country on the world map, 90.4% of its 160 million population is a Muslims. The Islamıc laws continue to be implemented in Bangladesh's civil law for the Muslim population. This thesis has been prepared on the historical development of civil law in Bangladesh and its evaluation according to Islamic law. İn this study, after giving general information about the political and geographical structure, religious population and Islamization of Bangladesh, the historical development of the legal system of Bangladesh was examined in periods and the civil law system in Bangladesh was evaluated in terms of Islamic law.
