Abstract
Bu çalışmada MK. nun 3. maddesinde düzenlenen iyiniyet karinesinin genel bir değerlendirilmesi yapılmıştır. İyiniyetin genel bir kural olup olmadığı tartışılmıştır. Doktrinde iyiniyete genel bir kural anlamı verme eğiliminde görüşler bulunmaktadır. Bununla birlikte iyiniyetin genel bir kural olmadığı fakat ispat yükü ile ilgili karine getirdiği ve iyiniyetin düzenlendiği tüm hallerin ana kuralların istisnalarını oluşturduğu sonucuna varılmıştır.
In this paper a general analyses was made the good faith conjecture that established by the 3rd article of Code Civil. It is discussed whether the good faith is a general rule or not. In doctrine there are some opinions tends to accept the good faith as a general rule. However we come to a conclusion that, good faith isn't a general rule but brings a conjecture related to proof and all establishments about good faith exist as the exceptions of the main rules.
