Abstract
Bursa şehri Osmanlı Devleti’nin ilk başkenti olması hasebiyle özellikle Osmanlı devlet kurumlarının kurulup geliştiği klâsik dönemdeki toplum yapısının aydınlatılması açısından önemli bir inceleme alanıdır. Osmanlı toplumunun temel yapı birimi olan ailenin dağılma sürecinin aydınlatılması için de, Osmanlı mahkemelerinde tutulan kayıtları kapsayan şer‘iyye sicilleri en önemli kaynaklar arasında yer alır. Zira o dönemde halk mahkemelere sadece aralarında meydana gelen anlaşmazlıkların çözümü için gitmiyordu. Bilakis basit bir vekil tayin etme işleminden kefalete, alım-satımdan kiralamaya, evlilikten boşanmaya kadar toplumda cereyan eden hemen tüm günlük hadiseler için mahkemeye başvuruyordu. Bu nedenle de şer‘iyye sicilleri o dönemdeki toplumun aynası konumundadır. Bursa şer‘iyye sicilleri özellikle klâsik döneme dair içerdiği çok sayıda defterle oldukça zengin bir veri tabanına sahip durumdadır. Bu araştırmada, Osmanlı Devleti’nin klâsik döneminde toplumun yapısını anlamak için vazgeçilmez bir kaynak olan şer‘iyye sicillerinden yararlanarak aile birliğinin hangi şekillerde dağıldığı açıklamaya çalışılacaktır.
Because of the fact that it was the first capital of the Ottoman Empire, the city of Bursa shows a curious lacuna and an important area of research illuminating the structure of society in the period in which most of the state’s foundations were established and flourished. While clarifying the process of dissolution of family, one of the major building stone of Ottomon society, Şeriyye Sicilleri comprising the registers recorded in the Ottomon courts constitute the most important category of sources. For, the people at that time appeared in the courts not only for solution of the discords and disagreements between them, but also for all the matters from appointing of a proxy to bailment, from purchase and sale to rent, marriage and divorce issues which occured almost everyday in the society. For that reason, just like a mirror, these registers reflect the structure of society clearly. Bursa’s Şeriyye Sicilleri, with it’s countless register books, have a highly rich database especially about the classical period. This research is intended to spotlight the reasons of the dissolution of conjugal community by utilizing the Şeriyye Sicilleri, an indispensable source for comprehensing the structure of society in the classical period of Ottoman State.
