Bursa sicillerinden Arapça kayıt örnekleri

Abstract

Osmanlı mahkeme kayıtları tarih, hukuk ve diğer sosyal bilimler için zengin veri içermektedir. Ancak bu kayıtların bir kısmı Arapça olarak tutulduğundan söz konusu dile hâkim olamayanlar pek istifade edememektedir. Biz burada söz konusu metinler üzerinde çalışacaklar için çeşitli nitelikteki belgelerden örnekler seçerek tercüme ettik. Bu kayıtlar belli bir kalıp içerisinde yazıldığından yapılan tercüme örnekleri diğer belgelerin okunmasında araştırmacıya kolaylık sağlayacaktır. Araştırmacı, örnekleri görerek klişe ifadeleri tanıma imkânı da elde edecektir.

Judge’s records or archives which comprise the Ottoman court’s registers give us very crucial historical data about the juristic and social structure of that period. The oldest of the Bursa’s archives or registers dates back to the second half of the 15th century. While initially, the dominant language was Arabic -and Turkish had rarer using-, then the process began to work backwards, i.e. Turkish’s usage increased, and Arabic decreased. The matter of “Why Arabic was so dominant in the 15th. and 16.th centuries’ registers or archives” is also a debatable topic. Possibly, these are the answers to this question: First, Arabic was still a predominant language in the scientific circles at that time. Second, Turkish then hadn’t been accepted largely as a jurisprudential language. And third, there might be an intention to keep the archives from the publicity.
