Abstract
Bu çalışma, Türkiye’de üzerinde oldukça sınırlı çalışılmış olan Marksizm’in uluslararası hukuk yaklaşımın ele alarak, bilinen uluslararası hukuk anlayış ve yöntemine karşı Marksizm’in nasıl bir tez ortaya çıkardığını incelemektedir. Marksizm’in genel olarak hukuk, özel olarak uluslararası hukuk teorisinin olup olmadığını tartışan çalışma, post kolonyal dönemde ve zamanımızda hegemonyanın etkin olduğu uluslararası hukukun karşı karşıya kaldığı çıkmaza eleştirel bakış açısını geliştiren Marksist yaklaşımın koyduğu çözüm seçeneklerini değerlendirmektedir. 1917’de Rusya’da gerçekleşen Ekim Devrimi sonucunda Marksizm’i temel alarak kurulan Sovyet Sosyalist Cumhuriyetler Birliği’nin bu temelde uluslararası hukuka getirdiği bakışı ve bu hukuku ne ölçüde etkilediğini ele alan bu çalışma, Sovyetlerin dağılmasından sonra ortaya çıkan gelişmelere Marksizm’in nasıl bir yaklaşım geliştirdiğini açıklamaktadır.
This study deals with the international law approach of Marxism, which has been studied very limitedly in Turkey, and also examines what kind of a thesis Marxism has come up with against the known concept and method of current international law. Discussing whether Marxism has a theory of law in general and international law in particular, the study evaluates the solution options put forward by the Marxist approach, which develops a critical perspective on the deadlock faced by international law in which hegemony is effective in the post-colonial period and in our time. As a result of the October Revolution that took place in Russia in 1917, the Union of Soviet Socialist Republics was established based on Marxism. Examining the perspective brought by this State to international law and how it affects international law, this study explains how Marxism developed an approach to the developments that emerged after the disintegration of the Soviet Union.
