| dc.description.abstract | İnsanlık tarihi kadar eski ve kıyamete kadar da devam edecek olan mülk sahibi olma ve mülkün el değiştirmesi uygulamaları pek çok araştırmanın konusu olmuştur. Benzer çalışmalar Osmanlı toplumu için de yapılmıştır. Osmanlı toplumunun önemli bir parçası olan gayrimüslimlerin mülk sahibi olma imkânları ve yöntemleri konusunda arşiv vesikaları içerisinde bol miktarda malzeme bulunmaktadır. Bu çalışmada da arşiv vesikaları ışığında gayrimüslimlerin mülk alım-satımları ele alınmaya çalışılmıştır. İnceleme neticesinde gayrimüslimlerin gerek kendi aralarında gerekse Müslümanlarla karşılıklı olarak ev, tarla, bağ, bahçe gibi gayrimenkuller alıp sattıkları, bu hususta bir engelle karşılaşmadıkları, konuyla ilgili işlemlerini mahkemelerde yaptırdıkları ve neticesinde tapu yerine geçen bir belge aldıkları görülmüştür. Gayrimüslimlerin alım-satım yöntemleri İslam hukukunun konuyla ilgili hükümlerine göre yürütülmüştür. İncelemenin temel kaynağını Bursa Şer’iyye Sicilleri oluşturmuştur. | tr_TR |
| dc.description.abstract | The purchase and sale of property is as old as human history and has been the subject of many studies. Similar studies have also been made for the Ottoman society. There are plenty of archival materials on the opportunities and methods to own property for non-Muslims who are important part of the Ottoman society. This article aims to study the purchase and sale of property in the lights of archive documents. The study shows that non-Muslims could purchase and sell real estate such as houses, fields, vineyards and orchards among themselves as well as Muslims; they did not encounter an obstacle in this regard; they had relevant transactions were made in the courts and got a certificate as a deed. The procedure of non-Muslims purchase and sale of property was carried out according to Islamic law. The main source of the study is Bursa Court Registers. | en_US |
