dc.description.abstractBu çatışma iki bölümden oluşmuştur. Birinci bölümde azınlıkların ortaya çıkması, tanımlanmaları ve tarihsel gelişimi araştırılarak Milletler Cemiyeti, Birleşmiş Milletler ve Avrupa Konseyi tarafından bu konuda yapılan düzenlemeler ile insan hak ve hürriyetleri çerçevesinde azınlıklara tanınan pozitif haklardaki gelişmeler üzerinde durulmuştur. İkinci bölümde, Türkiye'deki tarihsel süreçte azınlıkların tanımlanmaları ve hukuki statülerine değinildikten sonra Türk hukuk sisteminde esas alınan azınlık kriteri ve bu kriterin dayandığı hukuksal belgeler incelenerek bu kriterler dışında kalan azınlıklara pozitif hakların tanınmasında AB uyum yasaları çerçevesinde kaydedilen aşamalar araştırılmış ve değerlendirilmiştir. Çalışmanın amacı, hukuk Devleti ve demokrasi çerçevesinde Türkiye'de dinsel azınlıklara tanınan pozitif hakların diğer azınlık topluluğu kişilere de tanınması durumunda Türkiye'nin ulusal egemenlik ve toprak bütünlüğüne katkı sağlayacağını göstermektir.tr_TR
dc.description.abstractThis study consists of two chapters. Researching the emergence and definition of minorities with lıistor cal development the first chapter examines the provisions issued by League of Nations, United Nations and Europe Council, and developments in recognizing positive rights in the context of human rights and fundamental freedoms. In the second chapter having investigated the legal statutes and definition of minority in Turkey with historical background this study examines and evaluates the officially accepted minority criteria and legal documents supporting this criteria, and the provisional steps undertaken by Turkish Parliament in the context of EU accession law in recognizing positive rights for existed minorities out of the criteria accepted by Turkish law. The object of tlıis study is to indicate that in the case of ensuring positive rights and fundamental freedoms for minorities other than religious ones in accordance with law and democracy it will contribute to Turkish national sovereignty and territorial integrity.en_US
