| dc.description.abstract | İslâm hukukunun insanlara yarar sağlama, onlardan zararı giderme ve bu yolla toplum düzenini koruma gibi başlıca gayeleri olup, bunları gerçekleştirmek için benimsediği yollardan biri de kolaylaştırmadır. Dolayısıyla kolaylaştırma, İslâm hukukunda temel ilke olarak benimsenmiştir. Bu makalede; Kur’an-ı Kerim, Sünnet ve küllî kaidelerden hareketle “kolaylık prensibi”nin önemi ve temellendirilmesi üzerinde durulmuş ve İslâm hukukçuları tarafından bu prensibe dayanarak ortaya konmuş çözüm örnekleri tespit edilmiş ve böylece söz konusu prensibin tezahür şekillerine ışık tutulmaya çalışılmıştır. İncelemede Hanefî mezhebi esas alınmış, diğer mezheplere ise nadiren yer verilmiştir. | tr_TR |
| dc.description.abstract | One of the major aims of Islamic Jurisprudence is to protect and maintain the order in society by eliminating any harm from human beings and by providing them with good. One of the ways to materialize this aim is to facilitate the lives of the members of a given society. Muslim jurists throughout the history of Islam have made this notion as the principle of their methodology. This article attempts to exemplify this principle by reference to some of the distinguished cases in al-fiqh. However, the main source of these examples in the article is the Hanafi School of law.
