| dc.description.abstract | Carl Schmitt'in devlet kavrayışının ortaya konması çalışmanın temelini oluşturmaktadır. İlk olarak Cari Schmitt'in devleti "modern devlet" olarak anladığı üzerinde durulmaktadır. Daha sonra ise, devletin politik olan, toplum ve hukuk ile olan ilişkisi ele alınmaktadır. Cari Schmitt'e göre politik olan devlete öncel bir kavram olmasına rağmen, devlet bir kez varolduktan sonra politik olana hakim olmaktadır. Toplumu devletten ayrı bir varlık alanı olarak tasavvur etmeyen Cari Schmitt, devlete toplumun kendi kendini organize ederek ulaşılamayacağını iddia eder. Ona göre devlet, gerektiğinde normatif hukuk kurallarım kendi varoluşundan kaynaklanan meşruiyetine dayanarak aşabilen politik bir birliktir. Cari Schmitt için bu politik birliğin formu, karar zaafiyeti içindeki liberal demokrasi olamaz. Gerçek devlet, karar alma anlamında politik olana hakim olan bir devlet olmalıdır. Güçlü devlet ise, aldığı kararı aym zamanda uygulama kapasitesine de sahip olan devlettir. Son bölümde Schmittyen bir bakış açısıyla modern Türkiye'deki devlet anlayışı sorgulanmıştır. Bu açıdan bakıldığında Türkiye'de modern devlet, ilk olarak Cumhuriyet'le birlikte formuna kavuşmuştur. Türkiye'de politik olanı tekelinde tutan devlet, karar alma zaafiyeti içinde değildir. Fakat topluma hakim olmayı tam olarak başaramayan devlet, kararın gereğim yerine getirmekte soranlar yaşamaktadır. Bununla birlikte Türkiye'de devlet, gerektiğinde politik varoluşunun yarattığı meşruiyetine dayanarak normatif hukuk kurallarının dışına çıkabilecek kadar da güçlüdür. | dc.description.abstract | The main argument expounded in this study seeks to define Schmitt's theory of the state. First, it is emphasized that Carl Schmitt understands the state as "the modern state". Then, the relationships between state and the political, state and society, and state and law are analyzed. Although the concept of the political is prior to the state in Schmitt's view, once the state comes to existence then it determines the political. Carl Schmitt, who doesn't think the state and society as seperate entites, argues that the society can not construct the state by self organization. The state is a political unity that can violate normative law rules when necessary. This form of the political unity is not liberal democracy because liberal democracy lacks of decion power. The modern state is the state which has a dominancy on the political and which can give a decision. The strong state is the state which can give a decision and which can apply it. In the last chapter, the concept of the state in Turkey is analyzed by Schmittian concepts. It is argued the modern Turkish Republic is the first modern state in Turkish historical practice. As having decision power, Turkish Republic has dominancy on the political. But as dominancy on society is not perfect in Turkish Republic, the modern state confronts some problems in applying its decision. Nevertheles the state in Turkey is strong enough to violate normative law rules. | en_US |
