Abstract
İslâm hukukunun temel konularından biri de ibadetlerdir. Kişi ile Allah arasındaki ilişkileri düzenleyen ibadetler, tarihi süreçte genellikle içtihat alanı dışında tutulmuştur. İbadetlerin taabbüdî olmaları, onların içtihat alanı dışında tutulmalarını sağlayan en önemli unsur olarak görülmüştür. İnsan hayatında önemli yer işgal eden ibadetlerin asıllarında (özünde) içtihadın olmayacağı açıktır. Fakat zamanın ve şartların değişmesiyle uygulama noktasında birtakım içtihatların olduğu ve olabileceği muhakkaktır. Çünkü zaman ve şartların değişmesiyle ibadetlerin ifası sırasında bir takım düzenlemelerin yapılması, organizasyonun sağlanması, insanları, karşılaşabilecekleri sıkıntı ve zorluklardan kurtarmak bakımından gereklidir. Sonuç olarak, Hanefî mezhebinde ibadetlerin asıllarında (özünde) olmasa da, uygulamada kolaylık sağlamak ve insanları sıkıntıdan kurtarmak amacıyla birçok içtihadın yapıldığını tespit ettik.
Prayers are one of the basic subjects of Islamic jurisprudence. Prayers, which organize relationship between God and man, were kept out of interpretation during historical process. the basic reason fort this is that Prayer are related to worship. It is certain that some interpretations would take place with the advent of time and conditions. Because, with the advent of time and conditions, some arrangements and organizations, while practising prayers, would help man solving problems and difficulties. We used the term “interpretation” in the sense of “to solve man’s problems”. We started, in this dissertation, with the explanation of prayers, interpretation and Hanafid Jurisprudence. İn the seconde chapter, examples from el-Asl, el-Mebsut, Fethu’l-Kadîr, Bedâiu’s-Sanâi’ and Reddu’l-Muhtar were stadied and we also tried to find out the nature of the conditons which produced thise interpretations (ictihads). In conclusion, we found that many interpretations had been done, despite being opposed to the nature of prayers, just to facilitate and to solve man’s problems.
