Abstract
Çalışmamızın konusu, hicrî VII. yüzyıl Hanefî fakihlerinden Burhânüşşerîa'nın "Vikâyetü'r-rivâye fî mesâili'l-Hidâye" adlı eserinin tahkîk ve tahlilidir. Vikâye, Merğinânî'nin el-Hidâye'sindeki meselelerin derlenmesiyle oluşturulan muhtasar bir metindir. Çoğu hicrî VII. yüzyılda kaleme alınan ve "mütûn" (metinler) diye de ifade edilen muhtasarlardan biri olan bu eserin, Hanefî literatüründe önemli bir yeri vardır. Üç metin (mutûn-i selâse), dört metin (mutûn-i erba'a) ve altı metin (mutûn-i sitte) şeklinde gruplandırılan bu metinlerin tümünde Vikâye bulunmaktadır. Osmanlı ve diğer coğrafyalarda uzun süre fetva kaynağı olan ve ders kitabı olarak okutulan Vikâye, söz konusu metinler arasında -şerh, hâşiye, ta'lîk, ihtisâr, risâle, reddiye ve tercüme olarak- üzerinde en çok çalışma yapılan eserlerdendir. Kütüphanelerde yazma halde bulunan Vikâye'den yararlanmak, onu incelemek ve ona diğer muteber metinlerle mukayeseye giderek analizler yapmak gayesiyle hazırlanan bu tez, iki ana kısımdan oluşmaktadır. Birinci kısım, eserin tahlili ile ilgilidir. Üç bölümden oluşan bu kısımda; birinci bölümde, müellifin yaşadığı dönemin siyasî ve ilmî durumu, hayatı, Vikâye adlı eseri ve bunun Hanefî literatüründeki yeri incelenmiş ve kendisine nispet edilen eserler hakkında bilgiler verilmiştir. Ayrıca genel olarak Hanefî literatüründe muhtasarlar ve metinlerle ilgili bilgiler aktarılarak Vikâye'nin bunların arasındaki yeri belirtilmiştir. İkinci bölümde, Vikâye'nin şekil ve muhteva özellikleri üzerinde durulmuştur. Üçüncü bölümde de, özellikle el-Hidâye başta olmak üzere diğer temel metinlerle mukayese edilerek tahlillerde bulunulmuştur. Arapça olan ikinci kısımda ise, Vikâye'nin kronolojik olarak en eski nüshaları tespit edilip bunlar temel alınarak eserin tahkîki gerçekleştirilmiştir.
The subject of this study is the verification and analysis of the work named "Wiqaya al-riwaya fi masail al-Hidaya" that was written by Burhan al-Shari'a, a scholar on Hanafi fiqh who lived in the VII. century. Wiqaya is a mukhtasar text which was composed by the compilation of the issues in Marginani's al-Hidaya. The work, most of which was written in the VII. century and which was one of the mukhtasars also referred to as "mutun" (texts), has a significant place in Hanafi literature. Wiqaya exists in all these texts classified as three texts (mutun-i salasah), four texts (mutun-i arba'ah) and six texts (mutun-i sittah). Used as a course book and fatwa resource for a long time throughout Ottoman land and other geographies, Wiqaya is one of the most studied -in terms of annotation, footnote, script, abbreviation, booklet and translation- works among texts. Written with the objective of making use of Wiqaya, which can be found as manuscripts in libraries, investigating and analyzing it by comparing the work with other acknowledged texts, the thesis consists of two main parts. The first part is on the analysis of the work. This part consists of three sections. In the first section, the life of the author, the period's political and scholarly conditions, the work named Wiqaya and its place in Hanafi literature has been gone through and information about the works credited to him has been provided. Furthermore, information regarding mukhtasars and mutun (texts) has been maintained by introducing Hanafi literature in a general sense and the place of Wiqaya among these has been explained. In the second section, the form and content features of Wiqaya have been introduced. In the third section, an analysis has been performed by comparing the work with other texts, specifically al-Hidaya. In the second part that is in Arabic, the verification of the work has been carried out depending upon the oldest editions of Wiqaya after they have been chronologically identified.
