Abstract

Osmanlı Devletindeki kanunlastırma hareketleri, Tanzimat’ın ilanından sonra mevcut kanunların günün kosullarına uygun ve yeterli olamayısı nedeniyle, yeni bir ivme kazanmıstı. Gerek yabancı devletlerle olan iliskilerde ve gerekse imparatorluk içindeki azınlıkların haklarında yapılması öngörülen degisiklikler, yeni kanunların yapılmasını zorunlu kıldı. Osmanlı Devleti bu sorunu gerek yabancı kanunları aynen benimseyerek, gerekse günün sartlarına uygun kanunlar yaparak asmaya çalıstı. Mecelle’nin yapılmasındaki amaç, eksik olan Osmanlı Medeni Kanunu boslugunu doldurmaktı. 1876 yılında tümüyle yürürlüge giren Mecelle, 1926’da Türk Medeni Kanunu ve Türk Borçlar Kanunu’nun yürürlüge girmesine kadar, elli yılı askın bir süre imparatorluk topraklarında yürürlükte kaldı. Bu çalısmada, Mecelle’nin olusumundan Borçlar Kanunu’nun kabulüne kadar geçen süreç, tarihsel gelisim ve degisim baglamında incelenmistir. Ayrıca, Yeni Borçlar Kanunu’nun birinci kısmını olusturan genel hükümler kısaca anlatılmıstır. Mecelle’den Borçlar Kanunu’na geçis süreci hukuksal degisimi ifade etmekten baska; bir devrin sona erip yeni bir devrin baslangıcının da sembolüdür.
Legalizing movement in the Ottoman State had gained a new acceleration because of the recent laws became inappropriate and insufficient for the days conditions after the Tanzimat. Changes required both for the relations with foreign countries and for the rights of the minorities within the empire obliged to make new laws. Ottoman State tried to solve this problem both by adopting the foreign laws without any change and by making new laws appropriate for the day’s conditions. The reason to make the Mecelle was to supplement the lacuna of Ottoman Civil Code. Mecelle had full came into force on 1876 and was remained in effect for over a period of fifty years in the Ottoman land till the coming into force of Turkish Civil Code and Turkish Code of Obligations. In this study, process from the forming of Mecelle to declaration of New Code of Obligations is studied in the context of historical development and change. Furthermore, general provisions forming the first part of New Code of Obligations are shortly examined. Process of transition from Mecelle to Code of Obligations, other than expressing the forensic change, is also a symbol of ending of an age and starting of a new age.
