Abstract
Çalışmanın konusu Türk, Alman ve İngiliz hukukunda kural işlem niteliğindeki normların ve mahkeme kararlarının, bu sistemlerdeki hiyerarşik yerini ortaya koymaktır. Bu amaca ulaşmak için Hans Kelsen'in hukuk normlarının geçerliliğine ve normlar hiyerarşisine ilişkin teorisinden faydalanılacak ve söz konusu normların hiyerarşik konumu bu teori doğrultusunda belirlenecektir. Çalışmanın ilk bölümü teorik incelemeler için ayrılmıştır. Dolayısıyla, bu kısımda, Hans Kelsen'in hukuk normlarının geçerliliği ve normlar hiyerarşisine ilişkin teorisi tartışılacaktır. Bunun yanında, çalışmada farklı hukuk sistemleri açısından ayrıca incelememiz gerekecek olan normların beklenen hiyerarşik yerine ilişkin, her hukuk sistemi için geçerli olmasını beklediğimiz açıklamalar tekrara düşmemek amacıyla bu bölümde verilecektir. Çalışmanın ikinci bölümü, Türk hukuk sistemindeki kural işlem niteliğindeki normların ve mahkeme kararlarının hiyerarşik yerinin birinci bölüm kapsamında yürütülen tartışma uyarınca incelenmesini konu edinmektedir. Bu bölümde, Türk hukukunun hiyerarşik yapısı, inceleme konusu normların hukukî rejiminin kısaca incelenmesi ile ortaya konacaktır. Çalışmanın üçüncü bölümü Alman hukukundaki kural işlem ve mahkeme kararlarının hiyerarşik gücünün birinci bölümde benimsenen görüşler doğrultusunda belirlenmesini amaçlamaktadır. Türk hukuku dışında bir başka Kıta Avrupası hukuk sisteminin incelenmesinin, karşılaştırma açısından anlamlı sonuçlar sağlayacağı düşünülmektedir. Çalışmanın dördüncü ve son bölümü İngiliz hukukunun hiyerarşik yapısını ortaya koymayı amaçlamaktadır. İngiliz hukuku kendine has özelliklere sahiptir ve bu hukuk sistemindeki hiyerarşik ilişkilerin incelenmesi, Kelsen'in teorisi açısından zorlu bir sınav teşkil etmektedir. Amaçlanan, İngiliz hukuk literatüründe incelenmemiş olsa dahi, İngiliz hukukunda da normlar arasındaki hiyerarşik ilişkinin Türk ve Alman hukuk sistemlerinde olduğu gibi incelenebileceğini göstermektir.
Subject matter of this thesis is the determination of the hierarchical place of the regulatory norms and court decisions in Turkish, German and English legal systems. In order to achieve this purpose, Hans Kelsen's theory in relation to the validity of legal norms and hierarchy of norms will be examined and the hierarchical place of the mentioned norms will be determined in line with this theory. The first section of the thesis is reserved for theoretical inquiries. Therefore, in this section, Hans Kelsen's theory in relation to the validity of legal norms and hierarchy of norms will be discussed. Moreover, in order not to fall into repetition, explanations expected to be valid for all legal systems regarding hierarchical place of the norms to be evaluated separately for each legal system will be presented in this section. The second section of the thesis aims to investigate the hierarchical place of the regulatory acts and court decisions in Turkish legal system pursuant to the debate conducted in the first section. In this section, the hierarchical structure of the Turkish legal system will be revealed by a short examination of the legal regime of the mentioned norms. The third section of the thesis aims to determine the hierarchical power of the regulatory acts and court decisions in German law in line with the views adopted in the first section. It is expected that the examination of another legal system in civil law tradition apart from the Turkish law will provide significant results in terms of comparison. The fourth and the last section of the thesis aims to reveal the hierarchical structure of the English legal system. English law has some sui generis qualities and the examination of hierarchical relations in this legal system will prove to be a stern test for Kelsen's theory. The purpose is to demonstrate that, although it is not often the situation in English legal literature, the hierarchical relationship between the norms in English law can be examined just as in Turkish and German legal systems.
